Apple faced a potential legal challenge from Elon Musk, who indicated his intention to file a lawsuit, alleging that Apple was reaping benefits from ChatGPT at his expense.
In a recent turn of events, billionaire entrepreneur Elon Musk has threatened to sue Apple for allegedly favoring OpenAI's ChatGPT over his own AI chatbot, Grok, in the App Store. Musk claims this preferential treatment constitutes antitrust violations, making it difficult for other AI companies to reach the top spot in the App Store.
This escalation forms part of a broader criticism of Apple's App Store practices, which have also been under scrutiny by regulators. In April, the European Union fined Apple €500 million for violating competition rules by restricting developers from directing users to cheaper options outside the App Store.
Additionally, Apple faces a federal antitrust lawsuit in the U.S. alleging it maintains an illegal monopoly in smartphone markets. The lawsuit, filed by the federal government and 20 states, accuses Apple of maintaining a monopoly power in the smartphone market.
Musk's accusations against Apple are not new. He has repeatedly criticized Apple's policies, especially its commission percentage and content moderation decisions. The strategic partnership between Apple and OpenAI has become a point of friction, with Musk advocating for open-source AI while Apple and OpenAI move towards a closed and commercial integration.
The deliberate omission of Grok, which has risen from the 60th to the 5th position in a matter of weeks, from any of Apple's featured sections is a clear example of the editorial control Apple exercises over which applications gain visibility. The battle for control of AI is fought in visibility, with the position of apps like Grok or ChatGPT in rankings being less important than the control over the narrative of artificial intelligence.
Musk maintains a long and tense relationship with OpenAI, a company he co-founded and left in 2018. In February 2023, Musk filed a lawsuit against OpenAI for breach of contract and fiduciary duty, although he later withdrew it in June.
As of now, Musk has not filed a lawsuit against Apple over this matter. He has announced his intention to take immediate legal action but has yet to provide evidence to support his claims. The situation remains contentious, with both sides positioning themselves for potential legal action in the future.
The architecture of the future digital, where AI will be the default interface, is at stake. Today's editorial decisions potentially determine which technological voices will dominate tomorrow. The feud between Musk and Apple reveals a deeper problem: who controls the narrative of artificial intelligence.
