The Chapman v. General Motors LLC fuel pump lawsuit settlement is a significant development for owners of certain Chevrolet Silverado and GMC Sierra trucks with Duramax diesel engines. The lawsuit, which concerns a class action claim over alleged defective high-pressure fuel injection pumps, may provide compensation to qualified Class Members.

What is the Settlement About?

The settlement aims to offer reimbursement for out-of-pocket repairs related to fuel pump defects, cash payments, medical expense coverage, lost wages, pain and suffering damages, and potential future repair costs. To participate, Class Members typically need to provide proof of ownership and documentation of defect-related damages such as repair receipts and medical records if applicable.

Benefits for Class Members

Class Members may be eligible for the following benefits:

  • Reimbursement for out-of-pocket repairs related to the fuel pump defects
  • Cash payments, typically ranging between $400 to $800 for eligible former owners
  • Compensation for medical expenses if injuries resulted from the defects
  • Lost wages if the defect impacted their ability to work
  • Pain and suffering damages for trauma caused by accidents or injuries
  • Possible coverage of future repair costs linked to the defect

Key Dates and Deadlines

  • The earliest the Court might issue Final Approval is at the Final Approval Hearing on January 21, 2025.
  • The deadline to file a Reimbursement Request Form is 60 days after the date the CP4 repair was performed.
  • The deadline to exclude oneself from the settlement is December 12, 2024.
  • The deadline to file Claim Forms for cash payments is six months after Final Approval, which could be as early as July 21, 2025.

Who are the Class Members?

Class Members are individuals who purchased a Class Truck from a GM-authorized dealer in California, Florida, Illinois, Iowa, New York, Pennsylvania, or Texas from March 1, 2010, through September 13, 2024.

Important Information

The settlement is pending final court approval as of mid-2025, so qualified Class Members should consider consulting a lawyer quickly due to applicable statute of limitations on filing claims. The Court's publicly available legal files can be accessed at the U.S. District Court for the Eastern District of Michigan in Detroit, Michigan.

The Reimbursement Program ends 12 months after Final Approval or when the truck reaches 200,000 miles (whichever occurs first). The Settlement also includes a Partial Repair Reimbursement Program, offering 50% reimbursement of costs paid for a CP4 repair performed at a GM-authorized dealership on or after the date of Final Approval of the settlement.

Class Counsel will ask the Court for service awards of $5,000 for each of the 11 Class Plaintiffs and reasonable attorneys' fees and expenses up to $15 million for litigating this case and securing the settlement. Class Members may ask to speak at the Final Approval Hearing at their own expense, but it is not mandatory.
