Social media giant Meta begins to leverage user posts from Facebook and Instagram, dating back to May 27, unless specified otherwise with an appropriate objection.

Failed to meet the cutoff for advanced artificial intelligence by the specified date.

Training Meta's AI: Navigating Options if You Missed the Deadline

In the event that you missed the May 26 deadline to opt out of Meta Platforms using your Facebook and Instagram data for artificial intelligence (AI) training, there are still steps you can take to control your future content.

While Meta proceeds to use public posts and other eligible data from adult users who did not opt-out, the opt-out option remains, albeit only applicable to future content after the deadline.

The procedure to opt out remains online and accessible only during a logged-in session, requiring users to provide the email linked to their account. While no reason is required, users must confirm the opt-out following a successful submission via email.

Personal chats on WhatsApp remain unaffected, possessing no opt-out option.

Prior to the deadline, the Consumer Advice Center NRW sought a legal prohibition to AI training with user content through an expedited procedure. However, the Higher Regional Court Cologne ruled that Meta could use user posts to train its AI (Case No. 15 UKl 2/25), thus upholding the current practice.

Given the implications of the May 27 deadline, users who missed this opportunity have no direct way to subsequently influence or revoke the use of their data for future AI training. While further legal challenges and collective actions may still prove viable routes to contest Meta’s use of data, individual users are left without built-in mechanisms to specifically control their data’s future AI usage beyond the cutoff date.

By opting out, users can ensure their future posts are exempt from AI training moving forward. It is essential to bear in mind that past data may still be part of the AI dataset unless users acted before the deadline.

In light of the ongoing AI training by Meta Platforms, the Commission has been asked to submit a proposal for a directive on the protection of workers from the risks related to exposure to ionizing radiation, specifically in the context of artificial-intelligence technology. As the use of technology advances, it becomes increasingly important to prioritize safety measures in this new digital frontier.

Considering the recent decision made by the Higher Regional Court Cologne, there have been no viable routes for users who missed the May 26 deadline to opt-out of Meta's AI training, emphasizing the significance of staying informed and acting promptly regarding data privacy concerns related to technology and artificial-intelligence.
